Abstrak Peranan internet dalam teknologi informasi telah digunakan untuk mengembangkan industri keuangan (financial industry) melalui modifikasi dan efisiensi layanan jasa keuangan yaitu dikenal dengan istilah Financial Technology atau Fintech. Fintech jenis pinjam-miminjam uang berbasis teknologi atau peer to peer lending (P2P-lending) merupakan jenis Fintech yang tumbuh pesat di Indonesia, kelebihan pinjam meminjam uang melalui layanan P2P-lending lainnya adalah syarat yang sangat mudah dan proses yang cepat dibandingkan meminjam uang melalui Lembaga Bank. Namun kemudahan transaksi yang ditawarkan oleh layanan P2P- lending justru memperlemah posisi dari konsumen. Abstract:
Tujuan penulisan ini yaitu untuk mengkaji lebih lanjut mengenai penerapan dan berlakunya kontrak standar dari perspektif teori utilitarianisme. Penelitian ini menggunakan penelitian hukum normatif, yang berdasarkan dari sisi normatif yang menemukan kebenaran dalam logika keilmuan hukum. Sehingga penelitian hukum normatif merupakan penemuan aturan atau norma hukum yang tercantum dalam peraturan perundang-undangan, perjanjian, putusan pengadilan, serta pendapat para ahli hukum. Jenis pendekatan yang digunakan yaitu pendekatan perundang-undangan dan pendekatan analisis konsep hukum. Hasil pembahasannya yaitu penerapan kontrak standar dalam perkembangan hukum pembangunan ekonomi yaitu apabila konsumen telah mencantumkan tanda tangan atas kontrak standar yang telah disodorkan pelaku usaha kepada konsumen, maka hal tersebut berarti konsumen secara tidak langsung telah menyetujuinya. Dilihat dari perpsektif Utilitarianisme maka Ketika Kontrak standar atau Klausula Baku memberikan manfaat bagi para pihak terutama bagi perkembangan hukum ekonomi terutama dalam bidang bisnis maka hal tersebut sesuai dengan aliran Utilitarianisme. The purpose of this paper is to examine further the application and enforcement of the standard contract from the perspective of utilitarianism theory. This study uses normative legal research, which is based on the normative side that finds the truth in the scientific logic of law. So that normative legal research is the discovery of legal rules or norms contained in statutory regulations, agreements, court decisions, and opinions of legal experts. The type approach used is the Statute Approach and Analytical Conseptual Approach. The result of the discussion is the application of standard contracts in the development of economic development law, namely if the consumer has signed a standard contract that has been offered by the business actor to the consumer, then this means that the consumer has indirectly approved it. Seen from the perspective of Utilitarianism, when the standard Contract or Standard Clause provides benefits to the parties, especially for the development of economic law, especially in the business field, it is in accordance with the flow of Utilitarianism.

Abstract:
This study discuses pluralism from the perspective of ethics. Pluralism is not only a matter of attitude or behavior with respect to interactions between groups and religions, but also covers the problems of the rules, boundaries, values, and norms that held where the attitude of pluralism goes on. Husein Muhammad is a Muslim thinker who pays attention to the ethical and practical aspects of pluralism. This research is a descriptive-analytic library research using interpretation method. The data was collected from two sources, namely the primary one which came from Husein Muhammad's works, and the secondary one which came from supporting works on pluralism and utilitarian ethics. The approach this study conduct is ethics of utilitarianism. This article discovers two dimensions of pluralism based on perspective of utilitarianism ethics, namely, action pluralism and regulatory pluralism. According to Husein Muhammad, action pluralism designates to the advantage that society will acquire from pluralism, while regulatory pluralism designates to the acceptability and restrictions of attitudes and behavior where pluralism goes on. [Penelitian ini bertujuan untuk melihat pluralisme dari sudut pandang etika. Pluralisme tidak hanya persoalan sikap atau perilaku dalam interaksi antar golongan maupun agama, melainkan juga menyangkut masalah peraturan-peraturan, batasan, nilai, dan norma yang berlaku dimana sikap pluralisme itu berlangsung. Husein Muhammad merupakan salah satu tokoh muslim yang memperhatikan aspek etis dan praktis dari pluralisme. Penelitian ini merupakan penelitian pustaka (library research) yang bersifat deskriptif-analitik. Analisis data menggunakan metode interpretasi. Pengumpulan datanya dari dua sumber, yaitu sumber primer berupa karya-karya Husein Muhammad, dan sumber skunder berupa karya-karya pendukung seputar pluralisme dan etika utilitarianisme. Adapun pendekatan dalam penelitian ini menggunakan pendekatan etika ulitarianisme. Artikel ini mengungkapkan dua dimensi pluralisme dalam tinjauan etika utilitarianisme, antara lain, pluralisme tindakan dan pluralisme peraturan. Menurut Husein Muhammad, pluralisme tindakan berimplikasi pada manfaat yang akan didapatkkan masyarakat dari sikap pluralisme, sedangkan pluralisme peraturan berimplikasi pada pembatasan-pembatasan sikap maupun perilaku dimana pluralisme masih dapat diterima.]

<p align="center"> </p><p>This legal research aims to examine the existence of Constitutional Court Decision No. 91/PUU-XVIII/2020 from utilitarian philosophy while paying attention to the concept of utilitarianism in Constitutional Court Decision No. 91/PUU-XVIII/2020. The urgency of this research stems from the controversy over the birth of the Job Creation Law which continues after the Constitutional Court Decision No. 91/PUU-XVIII/2020. The 'conditionally unconstitutional' decision on the Job Creation Law provides intellectual property from legal scholars; Remember, several points of view examine the problem. This legal research uses an approach and approaches to laws and regulations based on primary legal materials, secondary legal materials, and non-legal materials. The study results stated that the decision of the Constitutional Court no. 91/PUU-XVIII/2020 has the spirit of the utilitarian philosophy, which aims to maintain the proportionality aspect and provide guarantees for implementing the Implementing Regulations of the Job Creation Law. On the other hand, the spirit of utilitarianism in the Constitutional Court Decision No. 91/PUU-XVIII/2020 explains social issues by transforming a legal instrument of sequence from the issuance of the Job Creation Law.</p><p>Penelitian hukum ini bertujuan untuk mengkaji keberadaan Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020 dalam perspektif filsafat utilitarianisme; sekaligus menelaah berkenaan dengan implikasi dari adanya konsepsi utilitarianisme dalam Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020. Urgensi penelitian ini bermula dari Kontroversi lahirnya UU Cipta Kerja terus berlanjut pasca hadirnya Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020. Putusan ‘inkonstitusional bersyarat’ terhadap UU Cipta Kerja nyatanya memberikan perdebatan intelektual dari kalangan para sarjana hukum; mengingat, terdapat beberapa perspektif yang mengkaji persoalan tersebut. Penelitian hukum ini menggunakan pendekatan konseptual dan pendekatan peraturan perundang-undangan dengan didasarkan atas bahan hukum primer, bahan hukum sekunder, dan bahan non-hukum. Hasil penelitian menyatakan bahwa putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020 memiliki semangat filsafat utilitarianisme sebagaimana bertujuan guna menjaga aspek proporsionalitas serta memberikan jaminan terhadap terselenggaranya Peraturan Pelaksana dari UU Cipta kerja. Tujuan penelitian ini adalah mengkaji makna keadilan dalam perspektif filsafat hukum aliran utilitarianisme dan positivisme; serta menelaah makna ‘benar’ dan ‘adil’ dalam kacamata filsafat hukum. Jenis penelitian ini adalah penelitian hukum dengan menggunakan pendekatan konseptual dan perbandingan; sebagaimana mengkaji isu hukum menggunakan sudut pandang utilitarianisme dan positivisme. Bahan hukum yang digunakan sebagai referensi penelitian adalah bahan hukum dan bahan non-hukum. Hasil penelitian menunjukkan bahwa sudut pandang utilitarianisme memandang keadilan dan kebahagiaan sebagai orientasi utama; sehingga, aliran utilitarianisme justru memberikan ruang kepada pemutus hukum untuk mempertimbangkan konsekuensi positif dari suatu perbuatan kejahatan. Sedangkan dalam perspektif positivisme, keadilan dianggap sebagai tujuan utama dari hukum; sebagaimana dilatar belakangi oleh pandangan penganut aliran positivisme yang menyatakan makna keadilan sebenarnya adalah manakala keadilan yang tertinggi adalah ketidakadilan yang tertinggi pula. Kemudian, ‘benar’ dan ‘adil’ dalam pandangan utilitarianisme dan positivism menyatakan bahwa suatu hukum dapat dikatakan adil bila memenuhi unsur konstitutif hukum, bukan hanya unsur regulatif hukum semata (adanya peraturan perundang-undangan tertulis).

Perdebatan mengenai penerapan pidana mati di Indonesia memang tidak kunjung berakhir, termasuk pula dalam ranah pidana mati bagi koruptor. Penelitian ini menawarkan analisis reflektif berdasarkan aliran utilitarianisme yang melihat unsur kemanfaatan sebagai justifikasi dari pemberlakuan sebuah hukum. Sudut pandang utilitarianisme digunakan sebagai alat analisis karena kejahatan korupsi sangat berhubungan erat dengan keuangan negara, sehingga sanksi hukum harus dipastikan dapat menghasilkan manfaat bagi keuangan negara tersebut. Hasil penelitian menunjukan kemanfaatan yang dihasilkan sangat kecil, sedangkan harga yang harus dibayar sangat tinggi dalam penjatuhan pidana mati bagi koruptor ini. Dalam perspektif utilitarianisme penjatuhan pidana mati bagi koruptor tidak mencapai kesebandingan dalam kalkulasi cost and benefit.

AbstractIn this study aims to determine the legal phenomena that arise as a result of the criminal justice system, as a reflection of the development of criminal law both at the theoretical and practical level. The findings in this research are based on two approaches namely the statute approach as an approach based on the rule of law and the conceptual approach based on the conceptual approach. There are 3 (three) findings of legal phenomena in this study, namely: first, the presence of a double track system in the criminal mechanism in Indonesia. Secondly, there is a phenomenon of paradigm shifting the character of punishment in Indonesia and third, re-measuring restorative justice in the form of diversion mechanism based on the perspective of utilitarianism. In principle, crime is always closely related to criminal sanctions, but in the double track criminal system is directed at criminal actions. On the other hand, the phenomenon of paradigm shift in the character of punishment occurs in the juvenile justice system, namely the approach to criminal responsibility is done by bargaining an agreement between the perpetrators, victims and community involvement. Furthermore, measuring restorative justice based on a utility perspective, this finding found coherence between restorative justice in the form of diversion and utilitarianism. Therefore, the overall legal phenomena above are some manifestations of the legal reality that is present in the criminal system in Indonesia.Keywords: criminal paradigm shift; double track system; utilitarianismAbstrakPada penelitian ini bertujuan untuk mengetahui fenomena-fenomena hukum yang timbul akibat dari sistem peradilan pidana, sebagai suatu refleksi atas perkembangan hukum pidana baik pada tataran teoritis maupun praktik. Penemuan dalam penelitian didasari dengan dua pendekatan yaitu statute approach sebagai suatu pendekatan berdasarkan peraturan undang-undang dan conceptual approach yang didasari dengan pendekatan koseptual. Terdapat 3 (tiga) temuan fenomena hukum dalam penelitian ini yaitu: pertama, hadirnya double track system dalam mekanisme pemidanaan di Indonesia. Kedua, adanya fenomena pergeseran paradigma karakter pemidanaan di Indonesia dan ketiga, menakar kembali keadilan restoratif dalam bentuk mekanisme diversi berdasarkan perspektif utilitarianisme. Pada prinsipnya kejahatan tindak pidana selalu erat hubungannya dengan pidana sanksi namun dalam double track system pemidanaan diarahkan pada pidana tindakan. Di sisi lain, fenomena pergeseran paradigma karakter pemidanaan terjadi pada sistem peradilan pidana anak, yaitu pendekatan pertanggungjawaban pidana dilakukkan dengan cara bargaining kesepakatan antara pelaku, korban dan keterlibatan masyarakat. Selanjutnya menakar keadilan restoratif berdasarkan perspektif utilitis, dalam temuan ini ditemukan koherensi antara keadilan restoratif dalam bentuk diversi dengan aliran utilitarianisme. Oleh karena itu, keseluruhan fenomena-fenomena hukum tersebut diatas merupakan beberapa wujud kenyataan hukum yang hadir di sistem pidana di Indonesia.Kata kunci: double track system, pergeseran paradigma pidana, utilitarianisme

Kasus kekerasan terhadap perempuan dari tahun ke tahun masih banyak saja kasus yang terjadi. Dari sekian banyak kasus yang terlapor masih saja ada kasus yang tidak dilaporkan kepada pihak berwajib. Tujuan dari tulisan ini ialah untuk mengetahui implikasi dari utilitarianisme pada penindakan kekerasan terhadap remaja perempuan, terutama dalam hubungan pacaran pada remaja. Kekerasan dalam pacaran setidaknya meliputi: kekerasan fisik, psikis, ekonomi, dan seksual. Utilitarianisme sebagai dasar pengambilan keputusan yang berdasarkan kepada kebahagiaan yang berdasarkan kuantitatif ini berakibat kepada tidak dilaporkannya kasus kekerasan terhadap remaja perempuan dalam pacaran. Berkurangnya kebahagiaan atau ketengangan yang didapatkan oleh orang-orang yang terkait dengan korban mengakibatkan tidak dilaporkannya kasus kekerasan remaja perempuan dalam pacaran. Kebahagiaan berupa ketenangan dalam hidup dan masalah yang dianggap sepele oleh orang yang terkait dengan korban mengakibatkan tidak dilaporkannya kasus kekerasan.

Penelitian ini bertujuan untuk memberi gambaran konsekuensi antara pemikiran utilitarianisme dengan konsep persatuan Indonesia yang tertuang dalam sila kelima pancasila. Perumusan konsepsi ini menjadi sebuah upaya dalam mengatasi persoalan kekerasan dalam masyarakat yang mengalami peningkatan setiap tahun. Penelitian ini juga diharapkan dapat memberikan pandangan lain untuk mengatasi persoalan kekerasan dalam masyarakat dimulai dari akar persoalan dan akhirnya menemukan formulasi untuk mengatasi persoalan tersebut. Metode yang digunakan dalam penelitian ini adalah metode kualitatif dengan penggalian data menggunakan penelusuran literasi. Data yang ditemukan kemudian dilakukan klasifikasi dan dirumuskan kembali menjadi sintesis untuk menjawab persoalan dalam penelitian. analisis data dan keabsahan data dilakukan dengan pendekatan komparasi dan semiotika. Hasil dari penelitian ini menunjukkan adanya sebuah konsekuensi dalam pemahaman utilitarianisme dalam menentukan kebahagiaan bersama sehingga mewujudkan suatu persatuan yang damai dan jauh dari konflik. Persoalan kekerasan masyarakat dapat diatasi dengan konsep persatuan yang sudah menjadi nilai pokok dalam kehidupan masyarakat itu sendiri.

Kajian etika guru erat kaitanya dengan tindakan apa yang seharusnya dilakukan oleh pendidik selaku pelaku etis di dalam proses pendidikan. Beragam aliran etika muncul, salah satunya adalah aliran filsafat moral Utilitarianisme yang memiliki prinsip bahwa tindakan yang baik adalah tindakan memberikan kebahagiaan lebih banyak ketimbang kesedihan. Puncak dari pemikiran ini adalah kualitas dan kuantitas kebahagiaan manusia adalah suatu keniscayaan yang harus diperjuangkan. Filsuf pendidikan Indonesia yaitu Ki Hajar Dewantara memiliki pandangan yang serupa terkait dengan kajian etika. Menurut beliau tujuan mulia dari pendidikan adalah mengantarkan manusia untuk menemukan kehidupan yang teratur, tentram, damai, dan bahagia. Kehidupan yang bahagia adalah muara dari pemikiran KHD tentang pendidikan. Tulisan ini berusaha menumpahkan pemikiran reflektif penulis terkait dengan etika guru menurut Ki Hajar Dewantara dalam Balutan Filsafat Moral Utilitarianisme.

Political economy played a central role in the construction of the new Republic of Colombia through the influence of Ezequiel Rojas. In his pursuit of theoretical and practical guidance to organize a new society of free individuals pledged to happiness, Rojas looked to political economy for inspiration. However, the sources that Rojas drew on did not belong to the tradition of classical political economy; he based his own approach on other, less traditional sources; namely utilitarianism and ideology. In this text I aim to reconstruct this approach, showing its tensions and contradictions and the way in which Rojas tried to address them through religion.
La economía política jugó un papel importante en la construcción de la nueva República de Colombia en cabeza de Ezequiel Rojas. En busca de elementos teóricos y prácticos para organizar una nueva sociedad de individuos libres y destinados a la felicidad, Rojas buscó en la economía política inspiración. Sin embargo, no era la economía política clásica la que Rojas difundía en sus enseñanzas. Rojas construyó su propia propuesta a partir de tradiciones e influencias menos usuales: el utilitarismo y la ideología. En este texto pretendo reconstruir esa propuesta, mostrando sus tensiones y contradicciones y la manera como Rojas intentó conciliarse recurriendo a la religión.

Abstract:
Throughout his career as moral philosopher Hare has insisted that there is a rational way of arriving at substantive moral judgements. Hare develops this view - first presented in ' The language of morals' (1952) and ' Universalizability' (1955) - into the claim that rational agents are required to adopt utilitarian solutions to moral disputes. In ' Freedom and reason ' (1963) this claim is defended with reference to the view that the formal features of moral language (universalizability and prescriptivity)commit moral agents to a certain method of reasoning, and that this method of reasoning, when conjoined with facts about people's desires and preferences, leads us to accept substantive moral judgements consistent with those required by a form of utilitarianism. This view features throughout Hare's subsequent work, but the argument for it undergoes change. This means change in the defence of the claim that the meta-theory Universal Prescriptivism is consistent with a form of normative utilitarian theory, as this claim is argued for in 'Ethical theory and utilitarianism' (1976) and 'Moral Thinking' (1981). I shall endeavour to trace the chronological development of Hare's thinking, and will concentrate on developments in the argument for a theory of act-utilitarianism. I shall argue that the argument for utilitarianism gives rise to two major problems which arise from a specific feature of the argument, namely, the attempt to run the resolution of bi-lateral and multi-lateral cases of conflict along lines analogous to the resolution of conflict in the single-person case. Hare's argument requires that a decision-maker must identify the person with whom he reverses roles as himself, and that he must be prepared to concede that the things his recipient has good reasons for wanting are also reasons for him to want the same things. I argue that it is not possible to make coherent sense of the identity of the person in the reversed-role situation and that the motivational states a decision -maker is expected to deem 'his own' are not properly states of himself. If I am right, the 'identity'-question sits at the root of a motivational gap in Hare's theory.

Although the utilitarian character of modern architecture has been widely recognized, the relationship between Utilitarianism and architectural practice has not been adequately discussed. This thesis intends to contribute to this area with a historical study of the interaction of Utilitarianism and architectural practice in the social reforms of 18th and 19th century Britain. Edinburgh is used as an example to illuminate this historical process in more detail. From three angles: prison, poor relief and elementary education, this thesis discusses how Utilitarians influenced the reform process and how architecture was used as significant instruments to promote the reform schemes designed by Bentham and his followers. In prison reform, Bentham created the architectural model of the Panopticon to build a new punishment system based on disciplined prisons which could harmoniously align individual interest and public interest. He later introduced the same ideology and the Panopticon model into poor relief reform. Through the works of his followers, especially Edwin Chadwick, these Utilitarian ideas largely shaped the new poor relief system in Britain. Similar steps were later followed in elementary education reform. Together with the establishment of the national systems of poor relief and elementary education, a large volume of institutional buildings such as workhouses and board schools came into being, and many of them are still affecting our modern life. Based on these examples, this thesis ends with a theoretical discussion of the inadequacy of Utilitarianism as a complete ethical theory. Contrary to the optimism of Bentham and his 19th century followers, Utilitarianism is insufficient to be a practical guidance for everyday life. This inadequacy determines that Utilitarianism cannot provide a firm ethical foundation for architecture.

This dissertation develops and defends a utilitarian approach to global distributive justice: that part of political ethics that is concerned with the distribution of benefits and burdens across the members of distinct societies. Surprisingly little has been written by utilitarians, or by welfare consequentialists in general, on this topic. Many philosophers believe that utilitarianism is incapable of arriving at morally acceptable conclusions concerning global distributive justice, to the extent that it does not merit serious consideration in philosophical debates in the area. The central thesis of the dissertation is that that view is mistaken, and that utilitarianism in fact provides an attractive and useful way of conceiving of our global distributive duties. The main argument begins by distinguishing three types of goal at which principles of distributive justice might be directed. One such goal is the attainment by individuals of a minimally decent level of welfare, a second the treatment of individuals in accordance with norms of fairness, a third the obtaining of a certain degree of equality across individuals, for reasons independent of the first two goals. I then consider whether or not there is a utilitarian case for each of these goals at the global level. I argue that, while the utilitarian case for global equality per se is currently weak, a concern at the global level both for what I call "decency" and for distributive fairness can and should be incorporated into the framework of utilitarianism. I present an account of precisely what form these goals ought to take at the global level, how they intersect with concerns about domestic distributive justice and collective self-determination, and how they translate into duties on the part of individual states and international institutions.
(cont.) I also draw out the implications of the resulting principles and duties for some specific aspects of global political economy and international law (including trade in goods, services and ideas; development; and immigration). The result is a distinctive conception of the ground, scope and content of global distributive justice that I hope will appeal, at least in part, to utilitarians and non-utilitarians alike.

Abstract:
Modelling ethics is critical to understanding and analysing social phenomena. However, prior literature either incorporates ethics into agent strategies or uses it for evaluation of agent behaviour. This work proposes a framework that models both, ethical decision making as well as evaluation using virtue ethics and utilitarianism. In an iteration, agents can use either the classical Continuous Prisoner's Dilemma or a new type of interaction called moral interaction, where agents donate or steal from other agents. We introduce moral interactions to model ethical decision making. We also propose a novel agent type, called virtue agent, parametrised by the agent's level of ethics. Virtue agents' decisions are based on moral evaluations of past interactions. Our simulations show that unethical agents make short term gains but are less prosperous in the long run. We find that in societies with positivity bias, unethical agents have high incentive to become ethical. The opposite is true of societies with negativity bias. We also evaluate the ethicality of existing strategies and compare them with those of virtue agents.

The paper thematizes the problematic relationship between economy and happiness covered by economist Robert Michels (1876-1936) in his book “The Economics of Happiness” written in 1918. In this book Michels, as a true frontier scholar, provides, well in advance of the acquisitions of the modern “science of happiness”, an interdisciplinary reading of the different determinants of happiness and of their interactions, courageously refuting the monistic and reductionist paradigm of neoclassical economy dominant in his epoch. The hedonistic conception of happiness conceived by Michels echoes that formulated by Jeremy Bentham, but Michels, unlike the Utilitarians of the eighteenth and nineteenth centuries, gives it an unexpected twist, by postulating heretically that happiness is the ultimate goal of economy and that wealth is only a means to achieve it. In establishing the primacy of happiness as the main purpose of economic activity, Michels follows in the footsteps of Neapolitan and Milanese Civil Economists of Enlightenment with whom he had other theoretical points of consonance which the paper highlights. However Michels’ conception of happiness differs from Civil Economists’ notion because it is primarily based on individual pleasure and not on relational goods, because it is disconnected from those components of gratuitousness which are immanent to sincere relational goods, because it is detached from the search for Common Good. Finally the paper illustrates the multidimensional and innovative public policies which Michels suggests for the achievement of happiness by invoking a wide range of integrated interventions to be carried out by the State and by the workers’ unions. This paper studies the optimal design of assisted reproductive technologies (ART) policies in an economy where individuals differ in their reproductive capacity (or fecundity) and in their wage. We find that the optimal ART policy varies with the postulated social welfare criterion. Utilitarianism redistributes only between individuals with unequal fecundity and wages but not between parents and childless individuals. To the opposite, ex post egalitarianism (which gives absolute priority to the worst-off in realized terms) redistributes from individuals with children toward those without children, and from individuals with high fecundity toward those with low fecundity, so as to compensate for both the monetary cost of ART and for the disutility from involuntary childlessness resulting from unsuccessful ART investments. Under asymmetric information and in order to solve for the incentive problem, utilitarianism recommends also to either tax or subsidize ART investments of low-fecundity-low productivity individuals depending on the degree of complementarity between fecundity and ART in the fertility technology. On the opposite, ex post egalitarianism always recommends marginal taxation.

Abstract:
In this paper we examine the evolution of the relation between ethics and economics. Mainly after the financial crisis of 2008, many economists, scholars, and students felt the need to find answers that were not given by the dominant school of thought in economics. Some of these answers have been provided, since the birth of economics as an independent field, from ethics and moral philosophy. Nevertheless, since the mathematisation of economics and the departure from the field of political economy, which once held together economics, philosophy, history and political science, ethics and moral philosophy have lost their role in the economics’ discussions. Three are the main theories of morality: utilitarianism, rule-based ethics and virtue ethics. The neoclassical economic model has indeed chosen one of the three to justify itself, yet it has forgotten —deliberately or not— to involve the other two. Utilitarianism has been translated to a cost benefit analysis that fits the “homo economicus” and selfish portrait of humankind and while contemporary capitalism recognizes Adam Smith as its father it does not seem to recognize or remember not only the rest of the Scottish Enlightenment’s great minds, but also Smith’s Theory of Moral Sentiments. In conclusion, if ethics is to play a role in the formation of a postcapitalist economic theory and help it escape the hopeless quest for a Wertfreiheit, then the one-dimensional selection and interpretation of ethics and morality by economists cannot lead to justified conclusions about the decision-making process.
