Abstract:
This article maps the journey of the intimate companionship between a concubine and a Rajput ruler—Gulabrai and Vijay Singh, respectively—in the late eighteenth-century kingdom of Marwar in western Rajasthan. Based on hitherto unexamined local evidence, the article explores the ways in which a bond of friendship was constituted and unfolded in the everyday spheres of interaction between the concubine and the ruler. By turning attention to their evident emotions, such as of grief, trust, loyalty and love for each other, and shared partnership in spheres of religion and administration, this article suggests that friendship co-existed and overlapped with other forms of attachments in the overtly hierarchical relationship between the concubinage partners in focus. To emphasize the distinct form of this intimate companionship, the article also takes note of other forms of friendships that were centred on the agency of the concubine in the Rajput polity, and, in this way this article advances on the limited historical knowledge on concubinage in Rajput households and opens the possibility of including cross-sex associations in the discourse on friendship in early modern South Asia.

Abstract:
John Wertheimer, the author of “Gloria's Story,” has produced a complex and absorbing text that skillfully guides the reader through the microhistory of Gloria's concubinage to an enhanced appreciation of the greater legal, social, and institutional forces at play in mid-twentieth century Guatemala. Using Gloria's story to shift into more general observations about law and society in Guatemala, Wertheimer states that laws can “affect behavior by establishing incentives and disincentives for different types of action and by reinforcing or undermining different values.” Wertheimer reads the legal records involving Gloria and her family to write her story from the dominant critical perspective of gender and class. He notes the way in which class distinctions played into the creation and maintenance of concubinages and the manner in which gender stereotypes bolstered such institutions. It is all exacting yet comfortable stuff for us to read. “Yes, yes, of course, exactly” we nod as we read of the individual and institutional gendered oppression meted out on Gloria and her children by Julio and the state. Nonetheless, Wertheimer's analysis delves deeper: Gloria may have gained in status and stability through her concubinage, and liberal reforms such as decriminalizing adultery and casting out distinctions between legitimate and illegitimate children may have had the unintended consequence of strengthening the institution of adulterous concubinage.

Abstract:
This article explores concubinage, a widespread form of quasi-marriage in Qing China (1644–1911), and its relationship with motherhood and social mobility. By examining legal codes and court records, this research challenges the academic paradigm, mainly based on literati writings, that portrays concubines as reproductive tools for their husband-masters and their husband-masters’ wives. It shows that bearing or raising sons or daughters helped concubines achieve upward social mobility recognized and protected by law and that motherhood remained the major source of power and security for concubines in the Qing. After household divisions, concubine-mothers gained lifelong custodial rights of property, which formally consolidated concubine-mothers’ upward mobility from daughters or widows in lower-class families to matriarchs in well-to-do households.

Abstract:
In our imperfect world, rape happens frequently but nearly no one publicly defends the legitimacy of forcible or nonconsensual sex. So pervasive is deference to some notion of consent that even Daʿish supporters who uphold the permissibility of enslaving women captured in war can insist that their refusal or resistance makes sex unlawful. Apparently, one can simultaneously laud slave concubinage and anathematize rape. A surprising assertion about consent also appears in a recent monograph by a scholar of Islamic legal history who declares in passing that the Qurʾan forbids nonconsensual relationships between owners and their female slaves, claiming that “the master–slave relationship creates a status through which sexual relationsmay become licit, provided both parties consent.” She contends that “the sources” treat a master's nonconsensual sex with his female slave as “tantamount to the crime ofzinā[illicit sex] and/or rape.” Though I believe in the strongest possible terms that meaningful consent is a prerequisite for ethical sexual relationships, I am at a loss to find this stance mirrored in the premodern Muslim legal tradition, which accepted and regulated slavery, including sex between male masters and their female slaves.

There are thousands of years of feudal marriage in Chinese patriarchal society, which means ancient Chinese women’s marriages were decided by the male family members instead of by themselves, and a man was able to marry a wife and several concubines. Lots of young women born into low-income families had to get married to wealthy older men to be concubines. Still, the life of being a concubine was tough, not only physically but also mentally hurt. The film Raise the Red Lantern describes a tragic story of a woman who turns from a college student into a psychotic abandoned concubine in the feudal Chinese patriarchal society, which reflects the detriment of the square-toed ideas and the yoke for the women in a highly gender-unequal marriage, especially in concubinage.

Contemporary and later Arabic texts provide much evidence that wayward conduct by elite young adult males was a source of considerable stress in early Abbasid cities. This brief essay turns on a question: to what extent is such conduct to be attributed to concubinage? I treat two sample texts, each describing untoward activity on the part of well-placed adult sons and its impact on the Abbasid body politic. Neither text, however, speaks to concubinage. What follows, then, is an argument from circumstantial evidence. Concubinage seems a most likely source, and so can reasonably be connected to the broader patterns of social disjunction of the first Abbasid period (roughly the mid-8th to mid-10th centuries).

Abstract:
This article examines concubinage in late Ming China through Foucaudian discourse analysis of sexuality in order to explore different responses to the Sixth Commandment by the Jesuits and Chinese literati. It will be interdisciplinary and conducted by way of philology, sexuality studies, feminist studies, cross-cultural criticism, and inter-religious dialogue. Topics include the relationship between religion and sexuality, concubinage in late Ming China, the Jesuits’ attitude towards concubinage, and the case study of the Confucian Catholic Wang Zheng’s struggle. A cross-cultural study of the Six Commandment not only illustrates the complex interaction between religion, sexuality, and gender but also presents early encounters of the Chinese and Christian cultures and the dialogues between them.

Le concubinage, comme les autres relations familiales, a tendance à s'internationaliser du fait de la mobilité des personnes, et de la mixité des couples. S'ajoute à ce premier phénomène la constatation que le nombre de statuts légaux du concubinage a considérablement augmenté dans les pays du monde. Afin de déterminer la loi applicable au concubinage, cette thèse opère une distinction entre deux catégories de relations hors mariage : le partenariat enregistré et la cohabitation hors mariage. Il est proposé de soumettre, d'une part, le partenariat enregistré à la loi sous l'empire de laquelle le partenariat a été enregistré, et, d'autre part, la cohabitation hors mariage à la loi nationale des concubins, ou à la loi de leur domicile commun.

L’étude a pour objet les couples composes d'un partenaire issu de l'immigration maghrébine et d'un partenaire d'origine européenne. A partir du postulat que les partenaires connaissent des résistances, la question centrale est de découvrir et de distinguer les stratégies qu'ils développent pour faire admettre leur exogamie. L’exploitation d'un échantillon d'entretiens conduit à recenser les conditions dans lesquelles les partenaires choisissent tel ou tel type d'union, la présentent comme provisoire ou permanente, la révèlent ou la taisent à leur entourage, les alliances qu'ils se ménagent et celles qu'ils écartent et les prétextes invoques pour justifier ou convaincre de leur option. Le paradigme de transaction sert à la découverte des zones d'ombre et d'ambiguïté. Des catégories sont élaborées selon trois variables : le sexe, la forme de conjugalité et le groupe d'appartenance. Ainsi sont dégagées les caractéristiques de ce type de mariage : nous observons systématiquement une rupture des maghrébines avec leurs parents, une mise en garde insistante adressée a leurs fils par les parents indépendamment de leur appartenance ethnique. En revanche, le concubinage est par excellence le lieu où les compromis sont envisages et réalises. Le succès des stratégies est évalué au regard des choix culturels opères, du maintien des relations familiales et du respect de quelques rituels. Se trouve confirmée l'hypothèse paradoxale selon laquelle les concubins, spécialement les femmes maghrébines, en dépit de l'opprobre traditionnel, parviennent à faire admettre à la fois la pertinence du concubinage et la légitimité de leur choix exogamique
This study focuses on couples where one partner is from a North African immigrant background and the other partner is of European origin. On the premise that partners meet with resistances, the central question is to discover and distinguish the strategies they develop to have their exogamous choice accepted. The examination of a sampling of interviews leads to an inventory of the conditions in which the partners choose the type of union, present it as temporary or permanent, reveal or conceal it to the people round them, the pacts they construct and those they set aside, and the pretexts they invoke to justify or convince others of their choice. The paradigm of transaction is used to bring shady areas and ambiguities into the open. Categories are drawn up according to three variables: sex, form of union, and ethnic origin. In this way the characteristics of this type of marriage are brought out : rupture between north African women and their parents, insistent warmings to sons, whatever their ethnic origin, are both systematically observed. On the other hand, cohabitation is the situation "par excellence" where compromises are envisaged and put into practice. The success of strategies is assessed with regard to the religious choices made, the preservation of relationships with the family, and the respect of certain rituals. The paradoxical hypothesis according to which cohabitants, especially North African women, despite traditional opprobrium, manage to have both the pertinence of cohabitation and the legitimacy of their exogamic choice acknowledged, is confirmed

Le concubinage est un fait juiridique difficile à définir, car il se présente sous différentes formes auxquelles correspondent différentes définitions, souvent élaborées par référence au mariage. C'est un mode de vie conjugale qui se distingue du mariage par l'absence de réglementation d'ensemble, mais il existe toute une construction législative et juridictionnelle qui constitue un véritable statut juridique. Durant la vie en concubinage, les membres du couple établissent entre eux et avec des tiers des relations juridiques d'où naissent des droits et des obligations auxquels s'appliquent soit le droit commun, soit, par extension, des règles du mariage, soit encore des règles particulières. Des relations professionnelles peuvent également s'établir entre eux (création d'une société, contrat de travail ou simple participation à l'activité de l'autre) et sont alors influencées par leur mode de vie. Le concubinage a également des répercussions sur les droits de sécurité sociale et les droits fiscaux des concubins. Les enfants ont le même statut, quel que soit le mode de vie du couple, du moment que la filiation est légalement établie, sous la réserve-provisoire, du statut de l'enfant né d'un adultère. Lorsque le concubinage prend fin volontairement (mariage des concubins ou séparation d'un commun accord ou unilatéral) ou involontairement (disparition, absence, décès), les acquis de la vie commune sont examinés et partagés le plus équitablement possible par tous les moyens que le droit procure actuellement (théorie de l'apparence, société crée de fait, gestion d'affaire, enrichissement sans cause, indivision). En cas de décès de l'un des concubins le droit applicable en matière de succession ne tient pas compte des évolutions de notre société et de la nouvelle morphologie de la famille. Le compagnon de vie est laissé de cotés, à l'exception du PACS, que des concubins hétéro ou homosexuels pourraient souscrire. La loi du 15 novembre 1999 sur le pacte civil de solidarité a introduit de nouveaus articles dans le code civil consacrés uniquement au concubinage. Les couples homosexuels ne sont désormais plus les exclus du concubinage

La première partie est consacrée à l'établissement d'une relation de concubinage (personnes qui vivent en concubinage, motifs qui sont à l'origine d'une telle relation. . . ). Dans la seconde partie, sont présentés les droits et les devoirs que le législateur et la jurisprudence reconnaissent aux concubins dans différents domaines en l'absence d'un statut du concubinage. Enfin, dans la dernière partie consacrée à l'évolution récente de la législation, sont notamment analysés le Pacte civil de solidarité en France (loi n° 99-944 du 15 novembre 1999) et la situation en Italie avec les propositions de loi présentées à partir de 1987 et les initiatives au niveau local
This dissertation is a comparative study of concubinage in France and in Italy from a sociological and a legal point of view. The introduction gives some indications on the terminology of concubinage and ends with a brief history of concubinage. This work is divided into three parts. The first one is dedicated to the relationship of concubinage (the persons who are living in concubinage, the purposes at the origin of such a relationship. . . ). In the second one, the rights and the duties that the legislator and the jurisprudence recognize to the concubines in varions domains in the absence of a status of concubinage are exposed. Finally, in the last part, which deals with the recent evolution of the legislation, the Civil Pact of Solidarity in France (law n°99-994 of November 15th 1999) and the différent propositions of laws presented in Italy since 1987 as well as the various initiatives taken at the local level are analyzed

Abstract:
In the continuous development of interactive art today, people pay more and more attention to the diversity of interactive methods, and Chinese opera performance has also derived many emerging technology carriers. For example, the virtual scene opera performance is based on human-computer interaction technology, which breaks through the limitation of time and space of opera performance, transforms from the theatre stage space to various types of virtual space, and makes use of various types of carriers and media such as image and sound to perform. Actors in the virtual space can create an interactive continuation of the virtual space through body changes or spatial scheduling. This not only enables the audience to appreciate the imagery of the "four skills" of Singing, Recitative, Acting, and Acrobatic Fighting in the choreographed movements of the opera but also to appreciate the spatial image of the "image outside of the image" and "image outside of the meaning".The virtual scene design of the Peking Opera "Farewell My Concubine" realizes the functions of multimedia participation in performance and construction of virtual scenes through digitally constructed performance scenes, which can be quickly applied to diversified opera performances, and at the same time, it has strong theoretical and practical application value in expanding the scope of the audience and expanding the effectiveness of trans-media digital opera dissemination, providing new possibilities for further combining the virtual scene design of the opera with human-computer interaction technology.

Abstract:
The first poetic cycle of 50 New Yuefu was written by Bo Juyi (白居易, 772–846) in 809 after the works of by his friend Li Shen (李紳, 772–846). Bo Juyi wrote it simultaneously with another great Tang poet Yuan Zhen (元稹, 779–831), and the new literary style has been known for centuries as Yuan-Bo (元白). Both of the poets shared the same attitude towards the role of letters in the society and aspired to implement their credo at the official posts they held. The origin of New Yuefu philosophy dates back at least to 806, when he together with Yuan Zhen created the illustrious political composition known as Celin (策林), where the bulk of their sociopolitical concepts were pronounced and stated. Most of these notions, inspired by Fugu movement, seem quite predictable and naive: the belief in an omni harmonizing role of ancient ritual, claim of necessity to promote worthy and knowledgeable, appeal to stop war and cut taxes. With all that this was a declaration of primary of benevolence over quasi orderliness, and this idea fully revealed later in New Yuefu poetry. Surely enough, New Yuefu have not been limited to the 50 poems, inspired by Li Shen. The new poetic experience gave birth to a whole literary trend, covering the most burning, up-to-date issues of contemporaneousness as well as the nearest past, picturing typical characters of different strata, pointing out social diseases and perils. The absolute trust in uppermost ritual role of a text has been embodied in such texts as, for example, Song of Eternal Grief (《長恨歌》), where the infamous story of Emperor Xuan-zong (玄宗, 685–762) and his favorite concubine Yang Gui-fei (楊貴妃, 719–756) found a new interpretation, that later would have become mainstream. Thus, the main conclusions are: 1) New Yuefu had a philosophic basement, carried out long before the first poem of the new style appeared; 2) its main goal was to revive the actual social role of poetry; 3) it had a great impact on the later Chinese poetry and social thought.
